Terms of Use

These Terms of Use ("Terms") are an agreement between you and TGC Network LLC ("TGC," "we," "us," or "our") governing your use of the Timer Board mobile application ("Timer Board" or the "App").
By downloading or using Timer Board, you agree to these Terms. If you do not agree, do not use the App. Our Privacy Policy is available at https://timerboard.app/privacy.
1. Eligibility
You must be legally capable of agreeing to these Terms. If you are not old enough to form a binding contract where you live, a parent or legal guardian must agree on your behalf.
2. License
Subject to these Terms and the applicable app-store rules, TGC grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use Timer Board on devices you own or control.
You may not copy, distribute, sell, lease, sublicense, modify, create derivative works from, reverse engineer, or attempt to extract source code from Timer Board, except to the extent applicable law expressly permits those activities despite this restriction. Separate open-source licenses govern the components identified in the App's open-source notices.
3. Timer Board and Pro
Timer Board provides timers, boards, alerts, history, and related time-management tools. Some features are free and others require Timer Board Pro.
The App and applicable store page show the current features, price, billing period, trial terms, and other material purchase information before you buy. Store-displayed terms control if they conflict with a marketing description.
We may improve, modify, or discontinue features. We will not knowingly describe a paid feature as available when it is not, and nothing in this section limits mandatory rights relating to paid digital content.
4. Purchases and subscriptions
Google Play or Apple processes purchases and administers payment methods, renewals, cancellations, and refunds. Your purchase is also subject to the applicable store's terms.
Subscriptions
Monthly and annual Pro subscriptions renew automatically until canceled. Before purchase, the App and store display the price, billing frequency, and any trial or introductory offer for which you are eligible.
If a free trial is offered, it converts to a paid subscription at the displayed price and frequency unless you cancel before the trial ends. The store determines eligibility. Cancel through the subscription settings for the store where you purchased. Cancellation normally stops the next renewal, and access normally continues until the end of the period already paid for, subject to applicable law and store rules.
One-time purchase
A Lifetime Pro purchase is a one-time, non-renewing entitlement for the platform where it was purchased. "Lifetime" means the useful commercial life of Timer Board on that platform, while the App remains available, compatible, and supported. It does not promise that the App or every feature will operate indefinitely. Mandatory consumer rights remain unaffected.
Platform separation and restore
Purchases made through Google Play and Apple are separate. A purchase on one platform does not unlock Pro on another. Use the App's restore function while signed in to the store account used for the original purchase.
Refunds and statutory rights
Request store-billed refunds through Google Play or Apple first because the store administers the transaction. This does not limit any non-waivable right or remedy you may have against TGC.
Consumers may have mandatory rights concerning conformity, updates, repair, replacement, price reduction, termination, refunds, cooling-off periods, or withdrawal. For digital content supplied immediately, a withdrawal right may end only where applicable law permits and after any required express consent and acknowledgment. Nothing in these Terms waives rights that cannot lawfully be waived.
5. Acceptable use
You must not:
- use the App unlawfully or to harm another person;
- distribute malware or interfere with the App, billing, or security;
- circumvent purchase requirements or access controls; or
- misrepresent your affiliation with TGC or Timer Board.
6. Your content and files
You control the labels, boards, sounds, and files you create or import. You are responsible for having the right to use that content and for any file you choose to export or share. TGC does not claim ownership of your content.
7. Intellectual property
Timer Board, its original software, branding, interface, and assets are owned by TGC or its licensors and are protected by applicable intellectual-property laws. These Terms grant only the limited license stated above.
8. Alerts and critical uses
Timer alerts depend on device power, operating-system behavior, permissions, volume, connectivity, and manufacturer settings. Timer Board is not certified as a medical device, emergency system, safety system, or legally required alarm.
Do not use Timer Board as the only safeguard for medication, health, safety, emergency, legal, financial, or other critical deadlines. Maintain an appropriate independent backup.
9. Availability and updates
We do not promise uninterrupted or error-free operation. Compatibility and availability may change because of operating-system updates, device limitations, store rules, security needs, or lawful discontinuation.
Where applicable law requires updates needed to keep paid digital content in conformity, we will provide them as required. You are responsible for installing available updates and maintaining a compatible device and operating system.
10. Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIMER BOARD IS PROVIDED "AS IS" AND "AS AVAILABLE." TGC DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
This disclaimer does not exclude any warranty, guarantee, or statutory right that applicable law does not allow us to exclude.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TGC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA, ARISING FROM OR RELATING TO TIMER BOARD.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TGC'S TOTAL LIABILITY ARISING FROM OR RELATING TO TIMER BOARD WILL NOT EXCEED THE GREATER OF USD 100 OR THE AMOUNT YOU PAID FOR TIMER BOARD DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These exclusions and limits do not apply to liability that cannot lawfully be excluded or limited, including liability for fraud, willful misconduct, gross negligence where applicable, death or personal injury caused by negligence, or mandatory product-liability and consumer-protection obligations.
For EEA and United Kingdom consumers, statutory rights on conformity of digital content, including repair, replacement, price reduction, or termination where the law provides them, are not affected by this section.
12. Suspension and termination
You may stop using Timer Board at any time. TGC may suspend or terminate your license if you materially breach these Terms, subject to any notice or cure period required by law.
We may discontinue the App for legitimate business, technical, legal, or security reasons. Any discontinuation remains subject to applicable store obligations and non-waivable consumer rights. Sections that by their nature should survive termination, including intellectual property, disclaimers, liability limits, and dispute terms, will survive.
13. Changes to these Terms
We may update these Terms for legal, security, technical, or product reasons. The updated Terms will state a new effective date. We will provide additional notice when required by law.
Changes do not retroactively reduce rights attached to a completed purchase unless applicable law permits it. If you do not agree to updated Terms, you may stop using the App and cancel future subscription renewals.
14. Governing law and disputes
These Terms are governed by the laws of New Mexico and applicable United States federal law, without regard to conflict-of-law principles.
If you are a consumer, this choice does not deprive you of mandatory protections or the right to bring a claim in a court available to you under applicable law, including in the EEA and the United Kingdom. Before filing a claim, you and TGC agree to try in good faith to resolve the issue through the contact address below, unless immediate action is necessary or law gives you another right.
For disputes that are not consumer disputes, the state and federal courts located in New Mexico have exclusive jurisdiction, and each party consents to those courts.
15. General terms
If a court finds part of these Terms unenforceable, the remaining parts will continue in effect, and the affected part will be enforced to the greatest extent permitted by law. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent, but TGC may assign them as part of a merger, reorganization, or sale of the App or relevant business, subject to applicable law.
These Terms, the Privacy Policy, the applicable store terms, and any purchase terms shown before checkout form the agreement governing your use and purchase of Timer Board. If they conflict, mandatory law controls first, then the purchase terms for that transaction, then the applicable store license terms, and then these Terms.
16. Apple App Store users
For Timer Board obtained through Apple's App Store, Apple's Standard Licensed Application End User License Agreement applies as the license agreement unless App Store Connect identifies a different agreement. These Terms supplement that agreement only where they do not conflict with it.
Apple and its subsidiaries are not responsible for Timer Board or for providing maintenance or support. TGC, not Apple, is responsible for addressing claims relating to Timer Board as required by the applicable license agreement and law. Apple and its subsidiaries are third-party beneficiaries of the applicable license agreement and may enforce it. You must also comply with applicable third-party terms when using the App.
